RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 482 Cr.P.C. praying for quashing of FIR No.0223, dated 15.09.2018, under Sections 409, and 477-A IPC, registered at Police Station, Civil Lines Bathinda, District Bathinda, and all the subsequent proceedings arising therefrom qua the petitioner.

It has been contended by counsel for the petitioner that since the date of registration of FIR, there is no progress in the investigation. He has also submitted that as per final report, Annexure P-2, 9 IDs were used, however, only the petitioner has been made an accused. Notice of motion to respondent No.1 only On asking of the Court, Mr.Sandeep Kumar, DAG, Punjab, who is present in Court accepts notice on behalf of the respondent/State and at the outset submits, on instructions from SI Jasvir Singh, that the case is under investigation as final report under Section 173 Cr.P.C. is yet to be filed.

CRM-M-10391-2023 -2After arguing for sometime, counsel for the petitioner prays for withdrawal of this petition with liberty to the petitioner to avail any other remedy as available to him under the law.

Allowed as prayed for.

Petition is dismissed as withdrawn with liberty aforesaid. However, the Court cannot ignore the fact that FIR was registered way back on 15.09.2018 and there appears to be no plausible reason for not completing the investigation. Hence, Investigating Agency is directed to complete the investigation expeditiously preferably within a period of two months from today in accordance with law.
