(Oral) Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C in case bearing FIR No.173 dated 13.06.2020 registered under Sections 21 and 29 of NDPS Act, at Police Station Sultanpur Lodhi, District Kapurthala. Notice of motion was issued on 29.01.2021 and arrest of the petitioner was stayed on the premise that the Police Officer signaled the motorcyclist to stop, the driver of the motorcycle tried to escape by turning the motorcycle, however, the motorcycle got slipped and the occupants of the motorcycle were nabbed. The occupants of the motorcycle were found to be Davinder Singh @ Bara and Balwinder Singh. 1.5 Kg of Heroine was recovered from them besides drug money. They also disclosed that one Brezza car was following them which was being driven by Mangal Singh and one Kuldeep Singh was sitting on the front side of the car. CRM-M-4057-2021 the basis of disclosure statements of Devinder Singh and Balwinder Singh. Thereafter, vide order dated 08.04.2021, the petitioner was directed to join the investigation. Learned counsel for the petitioner submits that in compliance of the order dated 08.04.2021, petitioner has joined the investigation to the entire satisfaction of the Investigating Officer.

Learned State counsel on instructions from ASI Gurdeep Singh admits the aforesaid fact and submits that the petitioner is no more required for further investigation in the case.

Learned State counsel further submits that even challan has been submitted to the trial Court. In view of aforesaid factual position, the interim order dated 08.04.2021 is made absolute. However, petitioner shall keep on appearing before the trial Court regularly. Petition stands disposed of.
