Challenge in the present revision petition is to the order 23.05.2017 (Annexure P-1) whereby the application filed by the defendantrespondent No.1 under Order 7 Rule 10 of the Code of Civil Procedure, 1908 (CPC) was allowed and the plaint was returned with liberty to the plaintiff-petitioner herein to file the suit at the place where the cause of action arose as well as to the order dated 23.10.2018 (Annexure P-2) vide which the appeal preferred by the plaintiff-petitioner against the order dated 23.05.2017 was dismissed by the First Appellate Court. 2.

Learned counsel for the petitioner would contend that the plaint has wrongly been returned as jurisdiction would lie in Chandigarh. 3.

In the present case, admittedly, the property is situated in Sirsa. As per the averments made in the plaint, the plaintiff-petitioner was allotted land in Village Haripura in the year 1959 and on 30.07.1974 he is alleged to Yogesh Sharma 2025.07.30 10:06 I attest to the accuracy and authenticity of this judgment/order.

CR-803-2019 (O&M) -2have been forcibly dispossessed by the Collector of Sirsa without resorting to the provisions of the Punjab Utilization Act, 1956. The dispute in the present case relates to land which is situated in Sirsa and the Court at Chandigarh possibly cannot have territorial jurisdiction. 5.

In view of the above, I do not find any merit in the present revision petition. The same being devoid of any merit is accordingly dismissed.
