The petitioner herein is a nationalized bank which claims to be the mortgagee of the property in dispute. The objection petition filed by the petitioner bank has been dismissed by the Executing Court. After addressing the arguments at sufficient length, the learned counsel representing the parties realized that in the impugned order passed by the Executing Court, there are a lot of mistakes with regard to the date on which the important events took place. They jointly pray for setting aside the impugned order dated 06.04.2018.

Keeping in view the aforesaid facts, the present revision petition is allowed and the order dated 06.04.2018 is set aside while directing the Executing Court to pass a fresh order, in accordance with law within the next six months. The parties, through their learned counsel, are directed to appear before the Executing Court on 05.10.2023. (Anil Kshetarpal) Judge September 01, 2023 "DK"
