  "-/ 01   Petitioner seeks pre-arrest bail in case FIR No.81 dated 10.01.2023 registered under Sections 379-A read with Section 34 IPC at Police Station City Panipat, District Panipat. FIR was lodged on the statement of Vikrant Malik as per which petitioner and Amarjeet Maan tried to snatch CNG cover of his vehicle on 10.01.2023 and then petitioner - Sudesh snatched part of the car and fled away. It is submitted by learned counsel for the petitioner that the complainant is a habitual offender and involved in more than 30 cases. The present FIR is a counter-blast to the complaint dated 06.12.2022 which was earlier made by Amarjit Maan against Vikrant (complainant of present FIR No.81 dated 10.01.2023) and Sombir under Section 379-A IPC.

Notice of motion.

On asking of the Court, Mr. R.S. Khaira, DAG, Punjab, accepts notice on behalf of respondent No.1.

Considering the aforesaid facts, the petition is allowed. Therefore, it is directed that in case of his arrest, the petitioner shall be released on bail subject to his furnishing

 

   bail bonds/ surety bonds to the satisfaction of Investigating Officer. However, it is further directed that the petitioner shall join the investigation as and when so required by the Investigating Officer. He shall not contact any person associated with the case to dissuade him from the investigation in any manner whatsoever and nor shall leave the country without prior permission of the Court. He shall further comply with the conditions stipulated in Section 438(2) Cr.P.C.
