AMIT RAWAL, J (ORAL) Present revision is directed against the impugned order dated 08.07.2015 passed by learned Civil Judge (Jr. Division), Jagadhari whereby the application of the petitioners filed under Order 7 Rule 11 CPC for rejection of plaint has been dismissed Before commencing the arguments, learned counsel for the petitioners very graciously pointed out that while issuing notice of motion by this Court on 10.8.2015, no stay was granted and by this time, the parties have led sufficient evidence besides bringing on record documents which was subject matter of the application.
This fact has not been disputed by the learned counsel for the respondents.
Without commenting upon any opinion on the merits of the case, I deem it appropriate to dispose of this petition with liberty to the petitioners to raise all the pleas available before the trial Court. Ordered accordingly. It is also hoped that the trial Court shall dispose of the suit as expeditiously as possible.
