The petitioner is seeking regular bail in FIR No.45 dated 11.03.2020, under Sections 302, 307, 341, 506, 323, 148, 149, 420, 467, 468, 471 of IPC registered at Police Station Civil Lines, District Bathinda. 2.
The brief facts of the case are that the present case has been registered on the statement of Baldev Singh to the effect that on 10.03.2020 the petitioner along with 18-20 persons gave grievous injuries on the person of Gurpreet Singh and Bhupinder Singh and lateron due to the severe injuries, Gurpreet Singh died.

Learned counsel for the petitioner contended that co-accused namely Paramveer Sharma has already been granted bail by a Co-ordinate Bench of this Court vide order dated 09.08.2024 in CRM-M-37589 of 2024. The petitioner is in custody since 14.03.2020 i.e. more than five years. Out of 28 prosecution witnesses, only 08 have been examined. Trial will take sufficient time to conclude.

Learned State counsel opposed the bail application by submitting that the main injury which proved to be fatal is attributed to the present petitioner as he gave an iron rod blow on the head of the deceased and the same is corroborated with the medical report. One of the co-accused has already been granted concession of bail by this Court vide order dated 09.08.2024 passed in CRM-M-37589-2024 but he misused the concession of bail and due to that, trial is lingering on. If the present petitioner is released on bail, he will also flee from justice as the prosecution has a good case against the present petitioner. Material witnesses are yet to be examined and prayed for dismissal of the petition.

As per the prosecution allegation, the present petitioner along with other co-accused caused injuries and the main fatal blow was attributed to him as he gave an iron blow on the head of Gurpreet Singh (since deceased) and same found support from the medical record on the file, so taking into consideration the role attributed to the present petitioner; the punishment provided under the Act and the fact that material witnesses are yet to be examined in this case, this Court finds no merit in the present petition and the same is dismissed. However, the trial Court is directed to make endeavour to conclude the trial preferably within six months as accused is in custody for the last 05 years.
