CRM-2819-2021 has been filed for withdrawal of the main petition which, as per averments in the application, has been filed due to a misunderstanding. Before dealing with the application, a few facts are required to be noticed.

Both the petitioners herein had earlier approached this Court for grant of anticipatory bail by way of CRM-M-17389-2020. This petition for grant of anticipatory bail was dismissed by a detailed order dated 04.08.2020. Subsequently, two regular bail petitions were filed before this Court -CRM-M-44000-2020 by Harpreet Singh (petitioner No.2) and CRMM-44101 of 2020 by Mehnaz Chauhan (petitioner No.1). On 19.01.2021 CRM-M-44000-2020 was dismissed as withdrawn and CRM-M-44101-2020 was adjourned to 22.02.2021.

After the passing of the orders mentioned above, the present petition i.e. CRM-M-4165-2021 was filed on 25.01.2021 on behalf of Mehnaz Chauhan and Harpreet Singh for grant of regular bail. CRM-M No.4165 of 2021 (O&M) -2the petition it has been mentioned that this is the first petition for grant of regular bail. The petitioners have now filed an application (CRM-28192021)for withdrawal of the main petition (CRM-M-4165-2021). Keeping in mind the fact that the application CRM-28192021has been moved at the outset before the main matter was listed for hearing, the same is allowed. The main petition (CRM-M-4165-2021) is permitted to be withdrawn.

Let a copy of this order be placed on the file of CRM-M-44101 of 2020.
