Counsel for the petitioner states that after the passing of the judgment and decree dated 02.04.2022 (Annexure P-1), the respondent filed an appeal which was rejected by the learned District Judge, Gurugram vide order dated 08.02.2023 (Annexure P-2). He submits that respondent has filed a second appeal before this Court which is pending. In the meanwhile, petitioner has filed an application (Annexure P-3) for passing of the final decree of partition which is being adjourned on the request of the respondent.

Counsel submits that a direction be issued to the Court to decide the application (Annexure P-3) in a time bound manner. 3.
