(ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.0170 dated 27.12.2020 under Sections 307, 186, 353 and 34 IPC registered at Police Station Tibber, District Gurdaspur. Learned counsel for the petitioner would contend that the petitioner herein is only the taxi driver, who had gone to pick up a passenger and he is not the person involved in dealing with intoxicant substance. It is argued that there was no intention of the petitioner to run over the police as stated in the FIR. It is also argued that reading of the remand paper would reflect that he was on the back seat and therefore, the question of driving the car would not arise. Investigation is complete and the challan stands presented, therefore, prays for concession of bail to the petitioner.

Learned counsel appearing for the respondent-State opposes grant of bail to the petitioner by contending that the petitioner himself admitted of being driver of the car and therefore, there was an attempt made PANKAJ KUMAR 2021.04.01 16:07 I attest to the accuracy and integrity of this document

CRM-M No.4323 of 2021 (O&M) -2by him to run over the police, who had set up a naka to apprehend one Harpal, who was stated to be indulged in dealing with intoxicant substances. I have heard learned counsel for the parties. Keeping in view the fact that the investigation is complete and the challan stands presented and the trial is likely to take some time to conclude, no useful purpose would be served in keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/ surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
