(ORAL) The revision petition is filed at the instance of petitionerplaintiff asking the Court to adopt the procedure under Order 37 CPC in the suit at the stage when the defendant has led the evidence. It is too late in a day whereas the plaintiff acquiesced with the trial of the suit in ordinary manner as the notice in the suit were issued in ordinary manner and party has put in appearance and treated the case as ordinary suit. I do not find any illegality and perversity in the order passed by the Court below, much less, the order cannot be said to be passed without jurisdiction. No ground for interference is made out. The revision petition is dismissed.
