Learned counsel for the petitioner submits that co-accused of the petitioner has been granted bail by the Sessions Court. Be that as it may, the present petition is disposed of with liberty to the petitioner to file a bail petition before the Sessions Court. It is clarified that filing of the present petition shall not come in the way of the petitioner for filing fresh petition before the Sessions Court and while deciding the fresh petition, it will be strictly on the terms of parity and nothing else. It is for the Sessions Court to find out whether the petitioner-accused is also entitled for bail on parity and whether his case is similar to the co-accused.
