After arguing for the some time, learned counsel for the petitioner submits that keeping in view the judgment passed by the Hon'ble Supreme Court of India in M/s Haryana Suraj Malting Ltd. vs. Phool Chand, 2018 (3) SCT 97, the exparte award can be set-aside by the labour court itself on filing of an application by the party concerned before the labour Court, hence, the present petition may kindly be disposed of having been not pressed any further with liberty to the petitioner to avail the said remedy of filing the application for setting aside the exparte award dated 05.07.2022 (Annexure P-1) before the labour Court. 2.

Ordered accordingly.
