ALKA SARIN, J. (Oral) The present appeal pertains to the year 2020. On 31.01.2020 none had put in appearance on behalf of the appellant and the matter was adjourned sine die. Thereafter, the case was listed on 22.09.2022, after duly informing the counsel for the appellant. However, none appeared and the case was adjourned to 18.01.2023. Prior to hearing on 18.01.2023, the counsel was yet again telephonically informed by the Registry about listing of the matter, however, none had appeared on behalf of the appellant and the following order was passed :

"On 22.09.2022, none had put in appearance on behalf of the appellant. Today also none has put in appearance on behalf of the appellant despite the case having been called twice.

In the interest of justice, adjourned to 03.02.2023. It is made clear that in case the matter is not argued on the next date of hearing the same will be dismissed for non-prosecution."
