Landlords are in revision directed against the order dated 18.5.2017 passed by the Rent Controller, Jalandhar whereby provisional rent for the demised "shop" has been assessed @ Rs.700/- per month.

It is contended that in the previous eviction petition filed by the petitioners/landlords against the respondent/tenant for the same demised "shop" the provisional rent has been assessed @ Rs.4000/- per month, which was upheld by the Appellate Authority in appeal. Thus, it is contended that the provisional assessment in the present eviction petition has to be made @ Rs.4000/- per month. CR 4727/2017(O&M) graciously accepts the aforesaid factual position in the light of orders dated 9.2.2015(P-3) and 4.12.2015(P-4).

In view of the agreed facts the present revision petition is allowed and the impugned order dated 18.5.2017 passed by the Rent Controller, Jalandhar is modified to the extent that the provisional assessment of rate of rent would be @ Rs.4000/- per month payable w.e.f. 1.7.2014 to 30.4.2017 in terms of the cited orders. Time for deposit of the modified assessed rent is extended till 26.10.2017. Disposed of in the above terms.
