**** ANOOP CHITKARA, J. (ORAL) In compliance of order dated 24.01.2023, the petitioner has given the following details:
Petitioner:
Vivek Tarar is in custody since 26.03.2022.
Father:
Lokender Tarar, aged 65 years, Mother:
Balesh Tarar (suffering from cardiac disease) Sister:
Versha (married to Yogesh Malik, who is in Indian Army and having two minor children namely Suryansh, aged 13 years and Shaurya, aged 9 years and both are school going). Mother-in-law of Versha has already expired Wife:
Neha Tarar, has one new born child of about 10 months and she is residing in her parental house.
A perusal of the aforesaid details reveals that although father of petitioner, namely, Lokender Tarar is 65 years of age but there is no mention of any kind of his ailment or any incapacitation of his father to look after his wife. Given above, father of petitioner is capable to take care of his wife i.e. mother of petitioner, as such, the present petition stands dismissed with liberty to file a fresh petition by annexing all the medical records and details of all adult family members of the petitioner.
