The revision petition is against the order refusing to set aside the ex parte order passed against the petitioner. The Court shall always be liberal in allowing for ex parte orders to be set aside under Order 9 Rule 7 CPC. The order passed already is set aside, dispensing with notice to the respondents subject only to the condition that the petitioner shall pay costs of `10,000/- to the plaintiff for obstruction caused to the trial of the case and inconvenience caused to the plaintiff. 2.

The order passed already is set aside and the revision petition is allowed. The written statement shall be filed within a period of one week from the date of receipt of copy of this order along with costs, failing which the defence will be struck off and the trial will progress without further opportunity to the petitioner-defendant.
