By way of present writ petition filed under Article 226/227 of the Constitution of India, petitioner has approached this Court inter alia for issuance of a writ in the nature of certiorari for quashing orders dated 24.03.2022, as well as 12.10.2022, Annexures P-5 and P-7, respectively, passed by the respondent authorities, whereby, petitioner has been fastened with liability to deposit deficit stamp duty, etc. 2.

Counsel for the petitioner submits that orders, Annexures P-5 and P7, are subject matter of challenge in revision petitions filed under Section 47-B of the Indian Stamp Act, 1899, as applicable to the State of Haryana. He submits that despite the fact that the revision petitions were filed in January, 2023, they have not been adjudicated by respondent No.2. Upon notice, petition has been contested by the respondents by filing a reply on behalf of respondents No.1 to 5. State counsel submits that the petitions could not be decided, as the incumbent was not available. However, he submits that the revisional Court is now functioning. 4.

Without adverting to the merits of the instant petition, since the petitioner has availed the alternate statutory remedy, writ petition is disposed of with a direction to respondent No.2, to decide the revision petitions within a period of four months, from the date of receipt of a copy of this order. 5.

It is clarified that interim order dated 23.01.2023, passed by this Court, shall remain in operation till the decision of the revisions by respondent No.2.
