(Oral) Learned counsel for the petitioner submits that he limits his claim to count service rendered by the petitioner as Auxiliary Constable (SPO) on daily wage basis prior to his regularization as Constable for the purpose of pensionary benefits. For this purpose, he has already served a legal notice, Annexure P-3.

Writ petition is disposed of with the observation that in case, legal notice, annexure P-3, has been received in the office of competent authority, a decision thereon may be taken as regards counting of service rendered by the petitioner as SPO for the purpose of pensionary benefits. In case of adverse order, same be conveyed to the petitioner.
