Mr. Gurcharan Dass, Advocate for the petitioner. JASWANT SINGH, J (ORAL) The tenant is in revision directed against the order dated 03.4.2017 passed by the learned Rent Controller, Ludhiana whereby her application for dismissal of the eviction petition, on the ground that the possession of the tenant is towards part performance of an agreement to sell dated 15.5.2005 executed by the owner/landlord-Puran Singh, has been dismissed. It is averred that the suit for specific performance of the agreement to sell dated 15.5.2005 qua the demised premises stands decreed on 13.1.2016 (P.6) in favour of the tenant-petitioner (plaintiff), however, it is not denied that an appeal filed by the respondent-Puran Singh against the said decree is pending and so are the execution proceedings filed by the petitioner.

After arguing for some time, learned counsel for the petitioner prays for permission to withdraw the present revision in order to raise all the pleas during the rent proceedings. Dismissed as withdrawn with the aforesaid liberty.
