Prayer made in the present petition is for recasting the seniority list, Annexure P-10, and thereafter all promotions or reversions are required to be made as provisional promotions given to non-qualified employees have been protected.

The preliminary submission of the respondent-State is nonjoinder of necessary parties, to which there was neither any replication filed nor application to implead. Even otherwise, due to efflux of time, the prayer made, might not even be surviving.

Disposed of, reserving the petitioners with a liberty to get it revived, in case need arises.
