(Oral) The prayer in the present petition under Article 226 of the Constitution of India is for quashing/setting aside the impugned order dated 24.09.2024 (Annexure P-4) passed by the respondent No.1, whereby the premature release case of the petitioner has been rejected without considering the instructions dated 21.03.2023 (Annexure P-5) and order dated 19.07.2023 (Annexure P-6) passed by this Court and further for issuance of directions to the respondents to consider the case of the petitioner for the premature release.

The State counsel fairly concedes that the case of the petitioner for grant of premature release would be covered by the Policy (Annexure P-2).

In view of the above, the impugned order dated 24.09.2024 (Annexure P-4) stands quashed. The appropriate authority shall take a decision on the application for grant of premature release moved by the KUSUM 2025.08.05 19:09 I attest to the accuracy and integrity of this document PHHC Chandigarh
