Present revision petition has been filed under Article 227 of the Constitution, inter alia, for quashing of impugned order dated 20.12.2021 (P-4) passed by learned Additional District Judge, Palwal, whereby the appeal filed by the petitioner on the ground of non-payment of ad-valorem court fee was dismissed.
Learned counsel, on instructions, submits that in terms of the order dated 20.12.2021 (P-4) passed by Ld. Appellate Court, entire advalorem court fee shall be paid within 2 (two) weeks from today. In view of the above, present revision is allowed and impugned order dated 20.12.2021 is set aside.
In case ad-valorem court fee is affixed within 3 weeks' from today, learned appellate court shall proceed in the matter on merits, in accordance with law.
Since this revision petition has been allowed without issuing notice to the opposite side, therefore, in case, the respondents feel SANJAY 2022.02.02 17:22 I attest to the accuracy and integrity of this document
CR-341-2022 (O&M) [2] aggrieved against the present order, they would be at liberty to move an application for recalling of the same.
