(Oral) Present application has been filed under Section 151 for permission to withdraw the present revision petition and to refund the amount of `50,000/- to petitioner, which was deposited in pursuance to the order dated 08.09.2016, passed by this Court. On 08.09.2016, notice of motion was issued by this Court and the petitioner was directed to deposit `50,000/- with the Registry within a period of one month. Subject to deposit of this amount, the execution proceedings was ordered to remain stayed. After notice in the main petition, no one has put in appearance on behalf of the respondent.

CM-21763-CII-2017 in/and -2CR-5243-2016 Now, by way of present application, learned counsel for the applicant-petitioner, seeks to withdraw the main revision petition as compromise has taken place between the parties and on 05.04.2017 statement of Harbhajan Singh-respondent has been recorded before the Executing Court where he stated that the compromise has been effected between the parties and the petitioner/judgment debtor has executed the sale deed in lieu of the execution amount and the execution stands fully satisfied.

Keeping in view the above-said facts, the present application is hereby allowed. Accordingly, the applicant-petitioner is hereby allowed to withdraw the main revision petition and further `50,000/- deposited by the petitioner with the Registry of this Court pursuant to order dated 08.09.2016, shall be released to him.
