The payment towards the award alleged to have been made before the award was passed was stated to be the objection at the execution stage when the decree holder put the award in execution. The grievance is that the payment of over two and half lacs rupees made by the petitioner has not been given due credit. This objection cannot be brought at the stage of execution and it will be open for the petitioner to bring a challenge in the manner known to law under Section 34 of Arbitration Act before the competent court.

Reserving to the petitioner such a right, the order would require to be sustained and accordingly sustained. The revision petition is dismissed with liberty to approach the competent court in the manner referred to above.
