Respondents-landlords inducted the petitioner as tenant vide rent agreement dated 1.4.1998 on the first floor, back side half portion of the right side measuring approximately 8' x 30' in SCO 52, Sector 20-C,Chandigarh at a monthly rent of Rs.10,262/-. An eviction petition was filed on the ground of non-payment of arrears of rent since October 2006. The petitioner/tenant denied the relationship of landlord and tenant.

The learned Rent Controller vide order dated 27.3.2015 has ordered eviction on the ground of arrears of rent. The Rent Controller found the rent agreement to be fully proved whereupon the signatures of the tenant were admitted. The plea of the tenant that he was not in possession of the demised premises was rejected as self serving statement, since he had brought no other evidence on record. The learned Rent Controller in the light of contents of rent agreement rightly held that there existed a relationship of landlord and tenant. The findings have been duly affirmed by the Appellate Authority, Chandigarh vide judgment dated 16.5.2017.
