(ORAL) This common order shall dispose of three civil revisions i.e CR Nos.489, 2654 and 2657 of 2018 filed against the orders passed by the Reference Court whereby the application filed by the petitioner for being impleaded as a party to the proceedings pending before that Court has been declined.
Irrespective of the merits of the case, against the claim of the petitioner, the contesting respondent does not have any objection if the petitioner is permitted to be impleaded as party to the proceedings pending before the Reference Court. However counsel for the contesting respondent has submitted that the entire effort of the petitioner has been to prolong the proceedings pending before the Reference Court. Therefore, if the petitioner is to be impleaded as a party, then the Reference Court be directed to take a final decision on the proceedings pending before that Court within a time bound frame.
Counsel for the petitioner has replied to this assertion of the counsel for the respondent by submitting that the petitioner would not seek any unnecessary adjournment before the Reference Court. It is further submitted that the petitioner does not have any objection if the proceedings pending before the Court below are ordered to be decided within a time bound frame; as is prayed for by the counsel for the respondents. In view of the above, without going into the merits of the case, the present petitions are allowed. The petitioner is ordered to be impleaded as party in the proceedings pending before the Court below. However, it is further ordered that the Court below shall dispose of the proceedings pending before that Court within a period of six months from the date of
-3receipt of certified copy of this order.
