(ORAL) Petitioner inter alia seeks issuance of mandamus directing the respondent bank to provide the requisite documents pertaining to the loan account of M/s Mani Packers, in which, deceased father of the petitioner was stated to be a guarantor. Despite numerous applications followed by various reminders, information is allegedly not being provided. 2.

On advance service of copy of petition, learned counsel for the respondent Bank joins the proceedings. He opposes the issuance of notice on the limited ground that the grievance of the petitioner qua nonproviding of information has already been redressed vide communication dated 27.05.2020 (Annexure P-7), vide which, the petitioner was asked to approach the Bank Officials after providing appropriate proof of his being a legal heir of the deceased guarantor (his father). On the face of it, the shoe seems to be on the other foot. As is borne out from letter dated 26.08.2020 (Annexure P-10) written by Bank itself, which has been addressed to the petitioner, concededly, as a legal heir. 4.

Confronted with the same, learned counsel for respondent No.1 Bank states that on petitioner approaching the bank officials the documents/information sought vide his pending representation dated 05.10.2020 (Annexure P-12) shall be provided to him. 5.

Petition is, accordingly, disposed of with a direction to the Bank to dispose of the pending representation of the petitioner within a period of 10 days from today by passing appropriate orders, in accordance with law, keeping in mind the aforesaid submissions of the learned counsel for the Bank. It is made clear that if any information, as sought by petitioner in his representation is not available with the Bank, the same shall be conveyed to the petitioner in writing.
