SUVIR SEHGAL, J. (Oral) The Court has been convened through video conferencing due to Covid-19 pandemic.

Through the instant petition, the petitioner seeks anticipatory bail in case FIR No.54 dated 27.09.2019 registered under Sections 323, 324, 506, 148, 149 of Indian Penal Code, 1860 (Section 326 of IPC was added later on) at Police Station Ghuman Kalan, District Gurdaspur. On 23.01.2020, following order was passed:- "Learned counsel for the petitioner submits that there was a cross fight and cross case vide DDR has been registered by Mohinder Singh son of Iqbal Singh, who is one of the accused in case FIR No.54 dated 27.09.2019. He further submits that the only allegation against the petitioner is regarding raising SAVITA KADIAN 2021.07.23 17:03 I attest to the accuracy and integrity of this document High Court Chandigarh

CRM-M-2967 of 2020 {2} a Lalkara. Still further, he submits that all the members of accused party have been granted concession of anticipatory bail vide order dated 18.11.2019 passed by learned Additional Sessions Judge, Gurdaspur.

Notice of motion for 09.03.2020.

Meanwhile, the petitioner shall join the investigation and would come present as and when called for and in the event of arrest, the petitioner shall be admitted to interim bail on his furnishing personal and surety bonds to the satisfaction of Arresting Investigating Officer. The petitioner shall also abide by the conditions as specified under Section 438(2) Cr.P.C." Learned State counsel, on instructions from SI Gurmukh Singh submits that the petitioner has joined investigation and is no longer required for custodial interrogation.

In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 23.01.2020 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
