The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioner, in case FIR No.237 dated 26.11.2022 registered under Section 420 IPC at Police Station City Kotkapura, District Faridkot.

Vide order dated 23.01.2023, petitioner was granted the concession of anticipatory bail in the following terms:- "Learned counsel for the petitioner inter alia submits that false allegations have been levelled in the FIR that the petitioner cheated the complainant in the sum of Rs.3.00 lacs on the pretext of sending her abroad."

Learned counsel for the State on instructions states that in compliance of order dated 23.01.2023 passed by this Court, the petitioner has joined the investigation and is not required for further interrogation. SONIA BURA 2023.04.17 17:14 I attest to the accuracy and integrity of this document

CRM-M-3548-2023 -22023:PHHC:052608 On a pointed query put to learned State counsel, he on instructions submits that the petitioner is not involved in any other case of similar nature. In view of the instructions received by the State Counsel that the petitioner has complied with the order dated 23.01.2023 passed by this Court and his custodial interrogation is not required for having allegedly committed an offence under Section 420 IPC, which is triable by the Magistrate, the petition is allowed and interim order dated 23.01.2023, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
