The substantive prayer made in the petition reads thus: 'It is, therefore, respectfully prayed that the present petition may kindly be allowed and Criminal Complaint bearing No. COMI-61 of 2023 (CNR No.PBHGD030021182023) dated 12.04.2023, under section326. 323, 506, 148, 149 IPC(Annexure P-3), in the Court of Shri Rajeev Pal Singh Cheema, Id. Chief Judicial magistrate, Gurdaspur and quashing of Summoning order dated 19.10.2023 (Annexure P-4) under section 326. 323.324, 506, 148, 149 IPC passed by the Court of Shri Shri Rajeev Pal Singh Cheema, Id. Chief Judicial magistrate, Gurdaspur and all other proceedings arising out of the aforesaid Criminal Complaint may kindly be quashed or set aside against the petitioners, in the interest of Justice.

It is Further prayed that during the pendency of the present petition the proceedings pending before the Ld. Trial court in criminal complaint bearing No. COMI-61 of 2023 (CNR No.PBHGD030021182023) dated 12.04.2023, under section326. 323.324, 506, 148, 149 IPC (Annexure P-3) ASHWANI KUMAR 2026.01.

CRM-M No.3480 of 2025 -2may kindly be stayed in the interest of justice.' 2.

Response filed by the State by way of status report dated 20.1.2026, reflects thus:

That during the completion of investigation, the Investigating Officer found that on 14.12.2022, Nishan Singh, son of Harbans Singh (respondent No.2), was not present at the spot at the time of the quarrel. He had caused self-inflicted injuries and procured a false medical certificate in order to falsely implicate the accused persons and register the present case. It is, therefore, not a case of genuine injuries sustained during the alleged incident. In this regard, a cancellation report was prepared on 06.06.2023 by the SHO, Police Station Dhariwal, with which the undersigned fully agrees. The said report was filed before the Ld. Illaqa Magistrate on 10.11.2025 after obtaining approval from the Senior Superintendent of Police, Gurdaspur. However, it is pertinent to mention here that respondent No.2/complainant did not agree with the said cancellation report.

That in the present FIR, after completion of investigation, Challan was presented on 28.08.2024 against (1) Satvir Singh, (2) Gurdeep Singh, (3) Baljeet Singh, (4) Harpal Singh, (5) Gurmukh Singh before the Ld. Trial Court and Charges were framed on 19.3.2025 and now the case is fixed for 17.11.2025 for prosecution evidence.' 3.

In view of the above, learned counsel appearing for the petitioners seeks to withdraw the petition in hand with liberty to challenge the summoning order dated 18.10.2024, in accordance with law. 4.
