(ORAL) Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.151 dated 13.11.2024 under Sections 18 (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the NDPS Act') (Section 29 of the NDPS Act added later on) registered at Police Station Dugri, District Ludhiana.

Vide order dated 21.01.2025, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner inter alia contends that the false implication of the petitioner in the present case is abundantly clear from the fact that he has no previous involvement in any case under the NDPS Act; the petitioner was not alleged to be present with the co-accused from whom 2 kgs 10 grams of opium (intermediatory quantity) was allegedly effected when he was intercepted on suspicion by the police. CRM-M-3306-2025 -2to be nominated as an accused on the basis of a disclosure statement allegedly suffered by the coaccused who claimed that the recovered contraband had been procured by him through the petitioner." 3.

Learned counsel for the petitioner submits that in compliance of order dated 21.01.2025, the petitioner has joined investigation and cooperated with the investigating agency. 4.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

On a pointed query, on instructions, learned State counsel has not contested the submissions made on the previous date of hearing qua the petitioner not being involved in any other criminal case much less under the NDPS Act.

In view of the above, the petition is allowed and interim order dated 21.01.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
