AMIT RAWAL J. (Oral) Petitioner-defendant is aggrieved of the impugned order dated 28.07.2016 (Annexure P-5), whereby, an application of the plaintiff for comparison of signatures of late Joga Singh @ Jog Raj, testator of the Will dated 27.06.1998, has been allowed On the last date of hearing, adjournment was sought to apprise the Court regarding original Will. It has been submitted that original Will has been produced on record. Even record of Cooperative Society has also been summoned. According to the respondent-plaintiff, Joga Singh had also appended his signatures in the proceedings of the Co-operative Society Tanda. He further submits that his client is not averse, in case examination of signatures is done by Forensic Science Laboratory. I have heard learned counsel for the petitioner and appraised the paper book.

CR No.5445 of 2016 {2} Since learned counsel for the petitioner made a statement regarding examination of signatures by an expert as original Will has been brought on record of trial Court, the fact remains that once both the parties are admitting and denying the signatures of Joga Singh, I deem it appropriate to modify the order under challenge and order that signatures of Joga Singh be examined by Forensic Science Laboratory, Mohali. With the aforementioned observations, the impugned order is modified and the revision petition stands disposed of.
