-.- AMIT RAWAL J. (ORAL) On 01.04.2016, this Court had passed an order in FAO No.4369 of 2008 whereby the Workmen Compensation Commissioner was directed to undertake the exercise of calculation but the same has not been done in accordance with the direction.

I am of the view that nothing prevents the petitioner to move an appropriate application accompanied with an affidavit giving calculation instead of challenging the same. Realizing this fact, the counsel for the petitioner seeks liberty to this Court to withdraw the revision petition and move an appropriate application accompanied by calculation. If such an application is moved, the Court below shall decide the same in accordance with law uninfluenced of the order passed on 27.04.2016. The revision petition is dismissed as withdrawn with liberty as aforesaid.
