I will not make any interference in favour of the plaintiff for consolidation of two suits in a situation where in one suit, he is not even a party. It appears that he has filed an application for impleadment and application has not been considered and orders passed. So long as orders are not passed, he is entitled to state that the decree obtained by the defendant in his own suit against public authorities will not bind him. There is no question of allowing him the luxury of consolidation of two suits only because the District Judge had allowed for transfer of the case to that Court. I will make no intervention now at this time. The petitioner is at liberty to apply to this Court or to the very same Court where the case is pending as and when he is impleaded as party in the suit filed by the defendant against the public authorities.
