CM No.15978-CII-2024 Prayer in the present application is for impleadment of legal heirs of appellant No.1 and 2, namely Raj Bala and Pritam as both of them had expired during the pendency of the present appeal. Application is allowed subject to just all exceptions and legal heirs of appellants No.1 and 2 as mentioned in the paragraph No.2 of the application appellants are ordered to be impleaded. Amended memo of parties taken on record.
Main case As agreed, as per statements of learned counsel for the appellant, learned counsel and representative of the respondent - Insurance Company (separately recorded), a sum of Rs.5,28,000/-(Rupees five lacs twenty eight thousand only) over and above the amount awarded by the Tribunal is allowed to the appellants in full and final settlement of the claim in this appeal. As per the statement of learned counsel for the appellants, the enhanced amount be paid to appellant Accordingly, we dispose of this case with a direction to the Insurance Company to deposit a crossed-cheque for Rs.5,28,000/- in the name of appellant with the office of the Lok Adalat of the High Court within six weeks, in compliance of this order, failing which, interest @ 9% per annum shall follow on this amount till payment from the date of this order. -2National Lok Adalat FAO No.2036 of 2002 concerned Officer of the Lok Adalat Branch/Office shall issue proper receipt after receiving the cheque to learned counsel/representative of the respondent - Insurance Company. The appellant counsel/appellant may collect the cheque from the office of the Lok Adalat.
The enhanced compensation amount shall be payable to the appellants, in the same proportion, as allowed by the Tribunal. Copy of the order be supplied/sent to the counsel/parties and file be returned to the Hon'ble High Court.
