By way of present writ petition filed under Articles 226/227 of Constitution of India, besides challenging the order dated 17.11.2016, passed by respondent No.2, dismissing the reference petition filed under Section 28A of Land Acquisition Act, 1894 (hereinafter referred to as '1894 Act') at the instance of petitioner, an alternate prayer has been made for issuance of writ in the nature of mandamus, directing respondent No.2 to proceed further with the reference dated 15.02.2017 filed under Section 28A(3) of the 1894 Act. 2.

Learned State counsel on instructions from ADA Sudeep, O/o LAC, Faridabad, informs this Court that the petition dated 15.02.2017 field at the instance of petitioner, invoking Section 28A(3) of the Act already stands referred to the Reference Court-cum-Addl. District Judge, Faridabad wherein, proceedings have already started and next date of hearing is 18.09.2023.

In view thereof, nothing substantial survives to be adjudicated in the present writ petition at this stage as the matter already stands referred to the Land Acquisition Tribunal which shall proceed further thereupon in accordance with law. 4.
