The revision petition is filed against the order permitting a withdrawal on the ground that there is no other provision available for challenging it and only a revision petition is the appropriate remedy. 2.

If the contention is that the advocate who acted on behalf of the party had no instruction to report a compromise or withdraw the matter, it ought to be a subject of consideration before the very same Court on a petition filed by party contending of lack of instruction and want of authority to the counsel who made that report. It is not possible for this Court to examine whether the counsel who acted on behalf of the party had the necessary authority to do so or what was the basis on which the counsel acted. It would involve evidence which is not possible before this Court to make an appraisal of. 3.

The revision petition is dismissed but the petitioner will have a liberty of approaching the same Court for applying recall of the PANKAJ KUMAR 2015.07.08 16:28 I attest to the accuracy and integrity of this document
