2019-08-14Mr. Justice Harminder Singh Madaan1 pages

IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH T.A. No. 63 of 2019 DATE OF DECISION :- August 14, 2019 Amandeep Kaur ...Applicant

Versus

Gurjit Singh

...Respondent

CORAM:

HON'BLE MR. JUSTICE H.S. MADAAN Present:- None for the applicant.

None for the respondent.

*** As per settlement/compromise arrived at between the parties through mediation they have decided to resume cohabitation in the matrimonial home at Patiala in rented accommodation. The other terms and conditions agreed upon between the parties are mentioned in the settlement including the condition of the parties having decided to withdraw all the civil/criminal cases filed by them against each other.

It being so, the application for transfer of petition under Section 9 of the Hindu Marriage Act from the Court of Civil Judge (Jr. Divn.), Ludhaina to the Court of competent jurisdiction at Patiala has become infructuous, therefore, the same is dismissed as compromised with an observation that in case the settlement is not acted upon and applicant still feels aggrieved on account of failure of respondent to withdraw the petition under Section 9 of the Hindu Marriage Act from the trial Court then she would be at liberty to approach this Court again by way of moving a fresh application.

(H.S. MADAAN) JUDGE August 14, 2019 p.singh Whether speaking/reasoned Yes/No Whether Reportable Yes/No PARVINDER SINGH 2019.08.14 15:18 I attest to the accuracy and integrity of this document Chandigarh
