(ORAL) Through this petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to petitioner - Gurminder Singh @ Gurwinder Singh @ Mangi in case FIR No.74 dated 21.12.2019 registered under Section 420 IPC and Section 13 of the Punjab Travel Professionals (Regulation) Act, 2014 at Police Station Garhdiwal, District Hoshiarpur, Punjab.

According to the prosecution, petitioner is indulged in human trafficking. On false assurance of sending son of the complainant to Canada to earn his livelihood, petitioner demanded `10.00 lakh from complainant, out of which complainant paid him `3.00 lakh. Learned counsel for the petitioner inter alia contends that petitioner is also a victim of fraud by travelling agent of Delhi. The bank account, in which amount of `2.50 lakh was transferred by the complaint, belongs to the travelling agent and not to the petitioner. Considering overall circumstances and the fact that petitioner is acting as a conduit in human trafficking, he is required for custodial interrogation. Therefore, he does not deserve the concession of anticipatory bail.
