IN THE HIGH COURT OF PUNJAB & HARYANA

AT CHANDIGARH CR No.5564 of 2016 (O&M) Date of decision:30.08.2016 Punjab Mandi Board and others ... Petitioners Vs.

Jagir Kaur and another ... Respondents

CORAM:

HON'BLE MR. JUSTICE AMIT RAWAL Present:- Mr. Sumit Jain, Advocate for the petitioners.

AMIT RAWAL J. (Oral) The petitioner-judgment debtors are aggrieved of the dismissal of the objections, whereby, the respondents being LRs of Mange Ram claimed the statutory benefits of family pension, gratuity, leave encashment, general provident funds and the group insurance scheme in pursuance to the judgment and decree passed in their favour.

Mr. Sumit Jain, learned counsel appearing on behalf of the petitioner-judgment debtors submits that everything has been paid and there is no group insurance scheme. Without noticing this aspect, the executing Court had ordered the petitioners to give entire benefits and, thus, they approached this Court vide CR No.7948 of 2014 (Annexure P-2) which was dismissed as withdrawn by giving liberty to move an application before the Executing Court informing the details with regard to the payments made in execution under various heads. Now the objections have been dismissed in Savita 2016.09.05 12:49 I attest to the accuracy and integrity of this document High Court Chandigarh

CR No.5564 of 2016 (O&M) {2} summarily without assigning any reasons.

I have heard learned counsel for the petitioners and appraised the paper book.

In case, the plea of Mr. Jain is accepted qua no group insurance scheme, neither review application nor Regular Second Appeal has been filed in this regard. The executing Court cannot go beyond the decree. If at all, the petitioners are aggrieved, they are well within their rights for redressal of their grievances in accordance with law but not in the matter and mode vide which the objections have been dismissed. No ground is made out for interference in the impugned order. Accordingly, the revision petition stands dismissed.
