(ORAL) Through this petition under Section 438 Cr.P.C., prayer has been made for grant of anticipatory bail to petitioner-Deepak Kumar @ Tona, in case FIR No. 222 dated 18.11.2019 registered under Section 61/78(2) of the Punjab Excise Act, 1814 at Police Station Dehlon, District Ludhiana.

According to prosecution, on the basis of secret information, vehicle bearing registration No. HP-67-1785, was intercepted by the police party. On its search, 1000 boxes of whisky containing 12000 bottles were recovered from the same.

Learned counsel inter alia contends that petitioner was not apprehended at the spot. He has falsely been implicated in the instant case. The vehicle from which the alleged recovery was effected does not belong to the petitioner.

CRM-M-3083-2020 -2Considering the overall facts and circumstances of the case and heavy recovery i.e. 12000 bottles of liquor, this Court is not inclined to grant the concession of anticipatory bail to the petitioner, inasmuch as, his custodial interrogation is very much necessary to know about the source, place of origin and modus operandi of alleged recovery. Dismissed.
