Report has been received from the Mediation and Conciliation Centre that the matter remained un-settled. However, at this stage, learned counsel for the respondent has made statement that the respondent has no objection, if the transfer application is accepted. In view of the statement aforesaid, it is pertinent to mention that the applicant-wife is seeking transfer of the petition under Section 13 of the Hindu Marriage Act, filed by respondent-husband, bearing No.DMC828-2024, titled 'Varun Nagpal vs. Mamta Nagpal', pending in the Family

TA-66-2025 -2Court, Rohtak and she seeks transfer of the same to the Court of competent jurisdiction at Hisar.

It is evident from the contents of the application that there is one son born from the said wedlock, who is about 16 years old. He is in the care and custody of the applicant. On account of this matrimonial dispute, there are four other litigations, which are pending in the Courts at Hisar. The respondent is facing trial in case FIR No.421 dated 15.06.2023 registered at Police Station Azad Nagar, Hisar under Sections 294, 323 and 498-A IPC. He is also making appearance in the petition filed under Hindu Adoption and Maintenance Act bearing CS-55-2023, which is pending in the Courts at Hisar. Besides the same, the maintenance petition filed by the applicant, is also pending the Courts at Hisar. Further, the respondent had filed petition for seeking custody of the child, which is also pending in the Courts at Hisar.

Considering the aforesaid circumstances and also the fact of applicant, not having any source of earning and further considering the statement by counsel for the respondent, the transfer application, is hereby allowed and the petition under Section 13 of the Hindu Marriage Act, filed by respondent-husband, bearing No.DMC-828-2024, titled 'Varun Nagpal vs. Mamta Nagpal', stands transferred from the Family Court, Rohtak, to the Court of competent jurisdiction at Hisar. The requisite record of the aforesaid case be sent by the Family Court, Rohtak to the District and Sessions Judge, Hisar.

Learned District and Sessions Judge, Hisar shall assign the said petition to the Family Court, Hisar. Even, the parties are directed to appear
