(ORAL) By way of the instant petition, the petitioner seeks the indulgence of this Court for issuance of a writ in the nature of mandamus directing the respondents to consider his claim for pension under "The Haryana State Shubhra Jyotsna Pension and other Facilities Scheme, 2018" as he had actively participated during the period of Emergency and had also remained imprisoned under the MISA Act, 1971. An alternative prayer has also been made by the petitioner to direct the respondents to consider and take the final decision on the legal notice dated 07.01.2021 as issued by him in this regard i.e. Annexure P-9, in a time bound manner. Notice of motion.

Learned counsel for the petitioner submits that the petitioner would be satisfied in case, respondent No.2 is directed to consider and take final decision on the said legal notice dated 07.01.2021 (Annexure P-9), in a time bound manner.

Learned State counsel has no objection for the same. Keeping in view the afore-discussed limited prayer of learned counsel for the petitioner and without commenting upon the merits of the matter in hand, the instant writ petition is hereby disposed of with a direction to respondent No.2, i.e. Deputy Commissioner, Ambala, to consider and take final decision on the said legal notice of the petitioner dated 07.01.2021 (Annexure P-9) in accordance with law, within a period of four weeks from the date of receipt of the certified copy of this order.
