Bharatiya Nagrik Suraksha Sanhita, 2023 seeking anticipatory bail for the petitioner in FIR No.300 dated 20.10.2025 under Sections 21(c) and 29/61/85 of the NDPS Act registered at Police Station Sadar Ferozepur, District Ferozepur. 2.

Learned counsel for the petitioner submits that initially the name of the petitioner was not mentioned in the FIR and he has been implicated in the instant case solely on the basis of a disclosure statement made by his coaccused Arshdeep Singh, from whom 3.716 Kgs of Heroin was recovered. It is further submitted that the alleged disclosure statement was suffered by Arshdeep Singh while he was in police custody and no independent witness has been joined by the police while recording his disclosure statement. Hence, the same is inadmissible in the eyes of law. He further contends that apart from the said disclosure statement, there is no other evidence or material to connect the





petitioner with the alleged offence. Counsel for the petitioner submits that the petitioner is ready and willing to join the investigation and to abide by the  '

 as may be imposed by the Court.

Larned State Counsel, on the other hand, has filed reply on behalf of the State and opposed the present petition on the ground that the allegations levelled against the petitioner and his role in the commission of the alleged offence are very grave and serious. He submits that as per the disclosure statement of co-accused Arshdeep Singh, the contraband was arranged from Pakistan with the help of a drone. He further submits that although no recovery was effected from the present petitioner at the time of his apprehension, but the investigation has revealed incriminating material which indicates towards the direct involvement of the present petitioner in the alleged offence.

Hence, he submits that in order to carry out further investigation in a proper manner and to reveal the truth, the custodial interrogation of the petitioner is very much essential. Therefore, he prays for dismissal of the present petition.

Accordingly, the present petition is allowed and the petitioner is granted anticipatory bail in the instant case. However, the petitioner is directed to join and cooperate in the investigation as and when required by the Investigating Agency/Officer. In the event of the petitioner joining investigation, he shall be admitted to interim bail by the arresting/investigating officer on his furnishing adequate bail/surety bonds to his satisfaction
