The instant petition has been filed by the petitioner under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in case FIR No.245 dated 25.08.2023 (Annexure P-1), under Sections 120-B, 354 IPC and Sections 8, 17 of Protection of Children from Sexual Offences Act, 2012 (Sections 323, 376-A,B IPC and Section 6 of POCSO Act, added later on), registered at Police Station City Pehowa.

Learned counsel for the petitioner contends that the prosecutrix has not supported the prosecution case.

Learned State counsel has informed that out of total 19 prosecution witnesses, 17 prosecution witnesses have already been examined and the trial is almost complete. Learned State counsel has filed custody certificate of the petitioner dated 03.08.2024, reflecting his period of custody as 11 months and 09 days, which is taken on record.

I have heard learned counsel for the petitioner and the learned State counsel and perused the paper book as well as the status report dated 05.03.2024, filed by the learned State counsel by way of affidavit of Sh. Rajat Gulia, HPS, Deputy Superintendent of Police, Pehowa, District Kurukshetra. 5.

In view of the facts and circumstances of the case, since the trial is almost complete, as such, the present petition is disposed of with directions to the trial Court to conclude the trial within a period of 01 month after the next date of hearing fixed before the trial Court, which is stated to be 24.09.2024. 6.

Pending miscellaneous applications, if any, shall stand disposed of. (HARPREET KAUR JEEWAN) JUDGE
