(ORAL) Present petition is directed against the eviction order dated 24.08.2011 passed by Rent Controller, Ambala and affirmed vide order dated 26.04.2013 by learned Appellate Authority, Ambala. After arguing for sometime counsel for the petitioner would state that he does not press the petition on merit; but the petitioner may be given six months time to make arrangement of alternative accommodation for his business.
Mr. Aditya Jain, learned counsel for the respondent/ landlord submits that he has no objection to the limited prayer made by learned counsel for the petitioner and agrees to the grant six months period to the petitioner/ tenant for vacating the tenanted premises. In view of the above, eviction order dated 24.08.2011 passed by the Rent Controller, Ambala and affirmed in appeal by the SANJAY GUPTA 2022.12.16 17:11 I attest to the accuracy and authenticity of this document
CR-5609-2013(O&M) [2] Appellate Authority, Ambala is confirmed, subject, however, to following conditions:- i) the petitioner shall hand over vacant possession of the tenancy premises to the respondent/landlord on or before 15.06.2023;
ii) the petitioner shall furnish an undertaking before the Rent Controller, Ambala within fifteen days from today that he will hand over vacant possession of the tenancy premises to the respondent on or before 15.06.2023; and iii) the petitioner shall clear arrears of rent/ mesne profit as directed by Rent Controller/ Appellate Authority, Ambala vide its order dated 24.08.2011/26.04.2013 within two months and shall continue to pay the same by seventh of each month in future;
Failure of the petitioner to comply with either of the conditions would entitle the respondent/landlord to execute the eviction order forthwith.
