Through the instant petition, as instituted under Section 482 of the Cr.P.C., the petitioner has sought issuance of directions upon the respondents No.1 to 3, to entrust the investigation of case FIR No.130 dated 29.08.2018, registered under Sections 306, 34 of the IPC, at P.S. Sadhaura, District Yamuna Nagar, to some independent agency for conducting proper and fair investigation.

On 14.05.2024, this Court had directed the Superintendent of Police concerned to file his personal affidavit, after looking into the matter and supervising the investigation of the FIR (supra). In deference to this direction, Mr. Ganga Ram Punia, IPS, Superintendent of Police, Yamuna Nagar, filed his affidavit on 13.08.2024. 3.
A perusal of the affidavit dated 13.08.2024 reveals that investigation of the FIR (supra) was conducted by Crime Branch and after obtaining approval from the D.G.P., Crime, Haryana, vide memo dated DEVINDER YADAV 2024.09.13 09:01 I attest to the accuracy and authenticity of this order/judgment
CRM-M-3080-2020 04.12.2019, to prepare untraced report, the untraced report was prepared on 15.01.2020. The said untraced report has been presented before the learned Magistrate concerned on 17.07.2024, whereupon, notice became issued to the complainant/petitioner for 03.09.2024. 4.
In view of the supervening events (supra), especially when an untraced report has already been presented before the learned Magistrate concerned, therefore, no further direction is required to be passed upon the instant petition. However, liberty is reserved to the petitioner to approach the learned Magistrate concerned for redressal of her grievance, if any, regarding defective and shoddy investigation etc. 5.
