Prayer in this writ petition is for quashing of order dated 24.01.2022 (Annexure P5) whereby petitioner has been transferred from Government College, Kheri Chopta, Hisar to Government College for Women, Narnaul.

Petitioner was initially posted at Government College, Faridabad (Urban) and joined there on 09.10.2017. Thereafter, he was deputed at Government College for Girls, Shehzadpur, District Ambala for six months vide order dated 06.09.2019 and his deputation was extended by six months by the respondent-department as the petitioner was yet to complete his period of service in rural area. It is stated that petitioner was then transferred to Government College, Kheri Chopta, District Hisar vide order dated 17.12.2020.

CWP No.1820 of 2022(O&M) [2] The said college, it is stated, also falls in rural area. Petitioner claims that he has been incorrectly transferred vide impugned order dated 24.01.2022 to a college which falls in the urban area, thereby not permitting petitioner to complete the stipulated period of rural service as per Haryana Education (College Cadre) Group-B Service (Amendment) Rules, 2013.

Notice of motion was issued in this writ petition alongwith notice re stay. Learned counsel for the State on previous hearing had apprised that despite numerous communications, no instructions were forthcoming. Accordingly, respondent No.2 was directed to remain present in Court on 19.05.2022 for which date this writ petition is listed for hearing. In the meanwhile, CM No.2575-CWP of 2022 was filed for preponement of hearing of the writ petition in which notice was issued for today.

Learned counsel for the State has produced communication dated 11.05.2022 from Director, Higher Education, Haryana, Panchkula to the learned Advocate General, Haryana informing that the petitioner's claim has been reconsidered by the respondent-department and impugned order dated 24.01.2022 has been cancelled vide order dated 10.03.2022. It is, therefore, submitted that the present writ petition is rendered infructuous. Photocopy of order dated 10.03.2022 is taken on record subject to just exceptions. Keeping in view the facts as above, hearing of this writ petition is preponed from 19.05.2022 to today itself. CM No.2575-CWP of 2022 is allowed.

Writ petition is disposed of as infructuous.
