The petitioner is aggrieved that stay application filed along with the suit is not being considered by the trial Court. According to him, he has already challenged the vesting that is alleged to have been taken place in favour of the Panchayat in writ petition and the matter awaits decision of the Court after full-fledged arguments before the five Member Bench. There has been a order of stay by the High Court in the writ petition challenging the vesting. The defendant is a person who is transferee from the Panchayat on the basis of alleged vesting. The application for stay is not being taken up and respondents are now trying to put up some construction.

I dispense with notice to the respondents and direct the trial Court to take up the application for injunction after serving notice to the defendants within two weeks from the date of receipt of copy of this order and communicate the fact of disposal to this Court. The revision petition is allowed with the above direction.
